1. Who you are agreeing with
Kaisei Weather (“the App”) is made and published by CodeTech, based in Poland (“we”, “us”, “our”).
- Developer
- CodeTech (NIP 7631936648)
- Address
- Wrocław, Poland
- hello@cutthefluff.eu
- Website
- https://www.cutthefluff.eu
These Terms of Service (“Terms”) are a binding agreement between you and us about your use of the App. Please read them together with our Privacy Policy, which explains how the App handles data.
2. Accepting these Terms
When you first open the App, the Welcome screen shows a consent line above the start button. Pressing start means you accept these Terms. The App records, on your device only, which version of these Terms you accepted and when. Nothing about that acceptance is sent to us or to anyone else.
If we make a material change to these Terms, we raise the terms version. The App then shows the consent line again on the next launch, and you are asked to accept the new version before continuing. If you do not accept, please stop using the App and delete it.
If you do not agree to these Terms, do not use the App.
3. Licence to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use one copy of the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions and by the App Store’s terms.
You may not, except to the extent that applicable law expressly permits it despite this restriction:
- copy, modify, translate or create derivative works of the App;
- reverse engineer, decompile or disassemble the App, or attempt to derive its source code;
- rent, lease, lend, sell, sublicense, distribute or otherwise transfer the App or your licence to it;
- remove, obscure or alter any copyright, trademark or attribution notice in the App, including the Apple Weather attribution and its legal link;
- circumvent, disable or interfere with the App’s in-app purchase or entitlement checks, or unlock paid themes by any means other than a genuine purchase;
- use the App to break the law, infringe anyone’s rights, or interfere with the App, Apple’s services or any network.
The App is licensed to you, not sold. We and our licensors keep all rights not expressly granted.
4. Who the App is for
The App requires iOS 26 or later on an iPhone. It is designed for portrait orientation on iPhone.
The App is not directed at children. You must be old enough to form a binding contract where you live and, if you are a minor, to have your parent or guardian’s consent. Under Polish and EU data protection law, the App is intended for people aged 16 or over.
5. What the App does
Kaisei Weather shows weather forecasts for your current location and for cities you choose to save, on four screens - Welcome, Weather, Locations and Settings - plus Home Screen widgets. Forecast data comes from Apple Weather through Apple’s WeatherKit service. City search and place names come from Apple Maps (MapKit).
The App has no user accounts, no advertising, no analytics or tracking, and no servers of ours. Your settings and saved cities stay on your device. See the Privacy Policy for the detail.
6. Weather information - important limitations
Please read this section carefully. It affects your safety.
6.1 Forecasts are predictions, not facts
Weather data in the App is supplied by Apple Weather and its own data sources. We do not create, verify, correct or control it. Forecasts, next-hour precipitation, climate averages, sunrise and sunset times, moon data, UV figures and the App’s one-line insights are estimates that may be inaccurate, incomplete, delayed or unavailable.
To protect Apple’s call budget and your battery, the App deliberately reuses recent data: a forecast under 30 minutes old is not refetched, Locations rows are cached for 60 minutes, and widgets reuse the app’s cached forecast until it is over 30 minutes old. What you see on screen may therefore be up to an hour old.
6.2 Severe weather alerts are a convenience, not a warning system
The App can show weather alerts issued by official agencies and, if you turn the setting on, send you a local notification about severe and extreme alerts for where your device is.
This feature is best-effort and must not be relied on:
- WeatherKit provides no push notifications and we run no server. Every check happens on your device, either during an iOS Background App Refresh or when iOS wakes the App because your device moved about 500 m or more.
- iOS decides if and when those checks run. They may be delayed by hours, or may not run at all - for example if Background App Refresh is off, Low Power Mode is on, the device is offline, battery is low, or iOS simply chooses not to wake the App.
- Alerts are only checked for the device’s current location, only while Use Current Location and the notification setting are both on, and only while the App has Always location permission.
- Each alert is notified at most once. An alert you have already seen in the App does not notify you.
- Alert coverage depends entirely on the issuing agency and on Apple’s service. Many regions have no alert coverage at all.
6.3 Do not rely on the App for safety-critical decisions
The App is for general personal information only. Do not use it for aviation, maritime or offshore activity, mountaineering, commercial agriculture, construction, emergency response, or any other decision where inaccurate weather information could cause death, personal injury, or damage to property or the environment. You are solely responsible for decisions you make based on the App.
6.4 Attribution
Apple requires that the Apple Weather logo and its legal link appear wherever forecast data is shown. The App displays these at the bottom of each weather page. You must not remove, hide or obscure them.
7. Location
The App asks for location permission only when it needs it:
- “When in use” - so the Weather screen can show the forecast where you are. You can decline and use saved cities instead, or turn Use Current Location off in Settings.
- “Always” - asked for only if you turn on severe weather alert notifications, because the check has to run while the App is closed. You can withdraw it at any time in iOS Settings, or by turning the notification setting off.
The App never stores your precise position. Coordinates are rounded to two decimal places (roughly 1 km) before any request leaves your device. You can change or revoke location permission at any time in iOS Settings › Privacy & Security › Location Services, and notification permission in iOS Settings › Notifications. Turning either off will stop the related feature working.
8. Buy a Coffee - purchases
8.1 What the purchases are
The App is free to download and fully usable without paying. If you would like to support it, Buy a Coffee in Settings offers three one-time, non-consumable in-app purchases, each of which unlocks its own set of visual themes:
| Coffee | Unlocks |
|---|---|
| Espresso | Espresso, Sakura Dawn |
| Americano | White Americano, Sumi Ink, Jasmine Tea |
| Latte | Latte, Hojicha Amber, Yuzu Sun, and the custom theme builder |
Key points:
- These are not subscriptions. Nothing renews and nothing recurs. You pay once per coffee.
- The three coffees are independent and do not stack. Each unlocks only its own themes. Buying the Latte does not include the Espresso or Americano themes.
- The purchases are cosmetic only. No weather feature, forecast, widget or alert is behind a paywall. Buying a coffee changes how the App looks, nothing else.
- Each coffee is Family Sharing enabled, so members of your Apple Family Sharing group can use it, subject to Apple’s rules.
8.2 How purchases work
All purchases are made through Apple using StoreKit and your Apple Account. We never see, receive or process your payment card, billing address or Apple Account credentials. Apple is the merchant of record.
Prices are those shown in the App Store for your region at the time of purchase, including applicable taxes. We may change prices for future purchases; a change never affects a coffee you have already bought.
Your entitlement is held by Apple, not by us, and is checked on your device each time the App launches. We store no record of what you bought. This has two consequences you should know about:
- Restore Purchases in Settings re-syncs your Apple Account’s purchases, so your themes follow your Apple Account to any device you sign in on.
- If a purchase is refunded or revoked, the themes it unlocked lock again automatically.
8.3 Refunds and your right of withdrawal
Refunds are handled entirely by Apple, not by us. We cannot issue, approve or refuse a refund. To request one, use reportaproblem.apple.com or contact Apple Support.
As a consumer in the EU you normally have a 14-day right of withdrawal from a distance contract for digital content. Because Apple is the seller, that right is exercised through Apple under the Apple Media Services Terms and Conditions. Note that this right may be lost once you have expressly consented to immediate delivery of the digital content and acknowledged that you thereby lose the right of withdrawal - which is what happens when a purchase completes and the themes unlock immediately.
Nothing in these Terms limits your statutory rights as a consumer, including your rights in respect of digital content that does not conform to the contract under Polish law implementing Directive (EU) 2019/770.
8.4 Your custom theme
If you own the Latte, you can build your own theme. The colours you choose are yours, stored only on your device, and we claim no rights in them. The theme builder, the App’s own theme library and the App’s design remain ours.
9. Your responsibilities
You agree:
- to use the App only for lawful personal purposes and in line with these Terms;
- not to interfere with Apple’s WeatherKit, MapKit or App Store services, or to use the App to place excessive or automated requests against them;
- that you are responsible for your device, your network and any data charges your use of the App incurs;
- that you will comply with any third-party terms that apply to your use of the App, including Apple’s.
10. Intellectual property
The App, its name, its terminal-style design, its pixel art, its theme library, its code and its text are owned by us or our licensors and are protected by copyright and other laws. “Kaisei Weather” and “Cut The Fluff” are our marks.
Apple, iPhone, App Store, Apple Weather, WeatherKit, MapKit, WidgetKit, iCloud and related marks are trademarks of Apple Inc. We are not affiliated with, endorsed by or sponsored by Apple. Weather alert text and agency names shown in the App belong to the agencies that issued them and are displayed unchanged.
11. Third-party services
The App depends on services we do not control:
- Apple Weather / WeatherKit - forecast data, including alerts.
- Apple Maps / MapKit - city search, place names and time zones.
- App Store / StoreKit - purchases and entitlements.
- iCloud - only if you have Apple’s device backup enabled, in which case your device backup includes the App’s data.
Your use of these is also governed by Apple’s own terms and privacy policy. We are not responsible for them, for their availability, or for the accuracy of data they provide. If Apple changes, limits, prices or withdraws a service, features of the App may stop working.
12. Availability, updates and changes to the App
We offer the App as it is and may change it at any time: adding, altering or removing features, themes, widgets or supported languages, and releasing updates through the App Store.
We may stop supporting or distributing the App, or discontinue it entirely, at any time and without compensating you. We will try to give reasonable notice on our website where we practically can. A purchased coffee does not entitle you to any particular feature, theme, or period of continued availability.
We do not guarantee that the App will be available, uninterrupted, error-free, or compatible with any future version of iOS.
13. Disclaimer of warranties
To the fullest extent permitted by law, and subject to section 15:
The App is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy or non-infringement.
We do not warrant that the App will meet your requirements, that it will operate without interruption or error, that defects will be corrected, or that any weather information, alert, forecast or notification will be accurate, timely, complete or delivered at all.
14. Limitation of liability
To the fullest extent permitted by law, and subject to section 15:
- We are not liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with the App.
- We are not liable for any loss or damage arising from your reliance on weather information, forecasts, alerts or notifications in the App, from an alert notification being delayed or not delivered, or from the unavailability or inaccuracy of any third-party service.
- Our total aggregate liability arising out of or in connection with the App and these Terms is limited to the greater of (a) the amount you actually paid us for in-app purchases in the twelve months before the event giving rise to the claim, and (b) EUR 50.
15. Consumer rights that cannot be excluded
Nothing in these Terms excludes or limits:
- our liability for death or personal injury caused by our negligence;
- our liability for fraud or fraudulent misrepresentation;
- our liability for intentional harm (wina umyślna) or gross negligence (rażące niedbalstwo) to the extent Polish law does not permit its exclusion;
- your mandatory statutory rights as a consumer under Polish law and EU law, including your rights regarding digital content that does not conform to the contract; or
- any other liability that cannot lawfully be excluded or limited.
If any provision of sections 13 or 14 is unenforceable against you as a consumer, it applies only to the extent permitted, and the rest of these Terms stays in force.
16. Apple-specific terms
These terms are required because the App is distributed through the App Store. You acknowledge and agree:
- These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- Scope of licence. Your licence to use the App is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the App Store Usage Rules, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App’s use of the HealthKit and HomeKit frameworks (which the App does not use).
- Intellectual property claims. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints and claims about the App should be directed to: CodeTech, Wrocław, Poland, hello@cutthefluff.eu.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the App.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and are deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
17. Termination
Your licence ends automatically if you breach these Terms, and you may end it at any time by deleting the App. Deleting the App removes its local data from your device; it does not remove purchases from your Apple Account, which you can restore later.
Sections 6, 10, 13, 14, 15, 16 and 18 survive termination.
18. Governing law and disputes
These Terms are governed by the laws of Poland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer habitually resident in another EU or EEA country, this choice of law does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of your country of residence.
Disputes are subject to the jurisdiction of the competent Polish courts, subject to the paragraph above.
As an EU consumer you may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr. Polish consumers may additionally seek assistance from the Municipal or District Consumer Ombudsman (miejski lub powiatowy rzecznik konsumentów) or the Office of Competition and Consumer Protection (UOKiK).
19. Changes to these Terms
We may update these Terms. The current version always lives at https://www.cutthefluff.eu/portfolio/kaisei-weather-app/terms, with its effective date and terms version at the top.
For material changes we raise the terms version, and the App asks you to accept again on the next launch. Minor corrections - typos, clarifications, updated contact details - may be made without a new version. Continuing to use the App after a change means you accept the updated Terms.
20. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the App, and replace any earlier version.
- Severability. If a provision is held invalid or unenforceable, the rest stays in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a transfer of the App, provided your rights are not reduced.
- Language. These Terms are written in English. A translation is provided for convenience only; if there is a conflict, the English version prevails.
